The O-1A is the temporary work visa for people with extraordinary ability in the sciences, education, business or athletics. It has no lottery and no annual cap, which makes it an alternative for those who do not want to depend on the H-1B lottery.

What the O-1A is
The O-1 is a nonimmigrant visa with two versions:
- O-1A: sciences, education, business and athletics.
- O-1B: arts, film and television.
For the O-1A, you must show sustained national or international acclaim and that you are coming to the US to work in your area of extraordinary ability.
- No lottery and no annual visa cap;
- No specific degree required;
- Premium processing is available for the I-129 petition.
The 8 criteria
As with the EB-1A, you can qualify with a major, internationally recognized award or by meeting at least 3 of 8 criteria (8 CFR 214.2(o)(3)(iii)):
| Criterion | Examples of evidence |
|---|---|
| 1. Awards | National or international prizes for excellence in the field. |
| 2. Selective memberships | Associations that require outstanding achievements of their members. |
| 3. Published material about you | Coverage in major media or professional publications. |
| 4. Judging | Judging the work of others as a juror, panelist or reviewer. |
| 5. Original contributions | Scientific, scholarly or business contributions of major significance. |
| 6. Articles | Authorship of scholarly articles in professional journals or major media. |
| 7. Critical role | A critical or essential role for organizations with a distinguished reputation. |
| 8. High salary | A high salary or other pay above the field's average. |
Comparable evidence is also accepted when a criterion does not fit your profession.
Who files the petition
Unlike the EB-1A, you cannot self-petition for an O-1A. The petition is filed by:
- A US employer, which can even be your own company in the US; or
- A US agent, useful when you will work for several clients or events.
The petition also needs:
- An advisory opinion from a peer group in your field;
- A contract or a summary of the terms of the work agreement;
- An itinerary of activities when the work involves events or several locations.
Duration and family
- Initial stay: up to 3 years, based on the length of the project or event.
- Extensions: in increments of up to 1 year while the same activity continues, with no maximum number of years.
- Family: your spouse and children under 21 receive O-3 visas. They can live and study in the US but cannot work.
The O-1A as a bridge to a Green Card
The O-1A and EB-1A criteria are similar. That is why many people start with the O-1A, work in the US, strengthen their record with results there, and later file for a Green Card through the EB-1A or the EB-2 NIW.
The right strategy depends on where you are now. The partner attorney assesses whether it makes more sense to start with the O-1A, go straight to the Green Card, or pursue both in parallel.
FAQ
Is the O-1A easier than the EB-1A?
The O-1A evidence standard is usually seen as somewhat less demanding, and it has 8 criteria instead of 10. But it requires a US petitioner and does not grant permanent residence.
Can I open a company in the US and be hired by it?
Yes, your own US company can be the petitioner, as long as there is a genuine employment relationship and the work is documented.
Can my spouse work on an O-3 visa?
No. The O-3 allows living and studying, but not working. To work, your spouse needs a visa of their own.
How long does it take?
With premium processing, the I-129 petition gets a response within a few business days. Then comes the interview at the US consulate in your home country.
